Enforcement Procedure

The complaints procedure is outlined in Article 13 of RD 1112/2018.

If a request for accessible information or a complaint has been rejected, the decision is disagreed with, or the response does not meet the requirements outlined in Article 12.5, the concerned party may file a claim. Similarly, a complaint may be filed if a response has not been received within the twenty working days period.

The complaint can be submitted via the General Inquiry Form (online) of the Ministry for Ecological Transition and Demographic Challenge, as well as through other available options outlined in Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations.

Complaints will be received and processed by the Ministry’s Complaints and Resolution Office.
