This legal notice establishes the general conditions that govern access to and use of this website, which is owned by the Ministry for Ecological Transition and the Demographic Challenge.
By accessing and using this website, the user explicitly and unconditionally agrees to these general terms and conditions as they are presented at the time of access, without prejudice to any additional terms and conditions that may apply to specific content or services available on the website www.datosabiertos.miteco.gob.es.
For the purposes of this document, the term ‘reuser’ refers to any individual or entity that reuses public sector information, regardless of whether the re-use is for commercial or non-commercial purposes.
Mandatory nature of the general conditions
The present general conditions, which are permanently accessible, shall be binding on any reuser by the mere act of using the documents to which they apply.
Authorisation for the non-exclusive reuse and transfer of intellectual property rights
These general conditions permit the reuse of the documents to which they apply for both commercial and non-commercial purposes. "Reuse" is understood to refer to the use of documents held by the bodies of the National Government and other organisations and entities of the state public sector, as outlined in Article 1.2 of Royal Decree 1495/2011, of 24 October, which implements Law 37/2007, of 16 November, concerning the reuse of state public sector information by individuals or legal entities, for either commercial or non-commercial purposes, provided that such use does not constitute a public administrative activity. Authorised reuse includes, by way of example, activities such as copying, distributing, modifying, adapting, extracting, reorganising and combining information.
The concept of "document" is defined in section 2 of Article 3 of Law 37/2007, of 16 November, on the reuse of public sector information, and therefore encompasses all information, regardless of its physical or electronic format, as well as the form of graphic, sound, or visual expression used. Consequently, this definition also includes data in its most disaggregated or ‘raw’ form.
This authorisation also includes the free and non-exclusive transfer of any applicable intellectual property rights associated with such documents, permitting the reproduction, distribution, public communication, or transformation activities necessary to carry out the authorised reuse, in any form and format, for all individuals and for the maximum duration allowed by law.
Using this Website’s Content
The following general conditions apply to the reuse of the documents to which they pertain:
- It is prohibited to distort the meaning of the information.
- The source of the documents being reused must be cited. This citation may be made as follows: "Source of data: Ministry for Ecological Transition and the Demographic Challenge.”
- The date of the last update of the documents to be reused must be indicated, insofar as it was included in the original document.
- It must not be stated, implied, or suggested that the Ministry for Ecological Transition and the Demographic Challenge, as the owner of the reused information, participates in, sponsors, or supports the reuse being carried out.
- The metadata regarding the up-to-date date and the applicable reuse conditions included, where relevant, in the document made available for reuse must be preserved without alteration or deletion.
